DEFIANCE COUNTY GRAND JURY INDICTMENTS FOR JANUARY 24

Defiance County Prosecuting Attorney, Morris J. Murray, has released the following information regarding recent Indictments returned by a Defiance County Grand Jury on January 22, 2025:  

Brittany N. Houck, age 33, 902 Latty St., Defiance, was indicted for One Count of Failure to Appear as Required by Recognizance, a Felony of the Fourth Degree. Authorities allege that on November 25, 2024, Houck failed to appear at the Defiance County Common Pleas Court for a pre-trial hearing, in connection with the commission of a felony, after having been released on a personal recognizance bond.

Michael B.T. Wilson, age 57, 2002 Baltimore St., Unit 11, Defiance, was indicted for One Count of Breaking and Entering, a Felony of the Fifth Degree, and One Count of Theft, a Misdemeanor of the First Degree. Authorities allege that on or about December 16, 2024, Wilson trespassed in an abandoned residence, on Baltimore St., in Defiance, and stole property from the residence.

Joshua A. Evans, age 43, 214 Clinton St., Apt. 5, Defiance, was indicted for One Count of Domestic Violence, a Felony of the Third Degree. Authorities allege that on January 10, 2025, at his residence on Clinton St., in Defiance, Evans caused or attempted to cause physical harm to a family or household member, and he has two prior domestic violence convictions, which elevate the level of this offense to a Felony of the Third Degree.

Rosemary McEwen, age 49, 6006 N. Linville St., Westland, Michigan, was indicted for One Count of Aggravated Possession of Drugs, a Felony of the Fifth Degree, and One Count of Operating a Vehicle While Under the Influence of a Listed Controlled Substance or a Listed Metabolite of a Controlled Substance, a Misdemeanor of the First Degree. Authorities allege that on October 19, 2024, on State Route 66, in Defiance, McEwen operated a vehicle while under the influence of Marihuana. Authorities further allege that during a traffic stop, McEwen was also found in possession of Methamphetamine, a Schedule II drug.

Aiden A. Barrett, age 19, 2606 Green Valley Rd., New Albany, Indiana, was indicted for One Count of Failure to Comply with an Order or Signal of a Police Officer, a Felony of the Third Degree. Authorities allege that on January 2, 2025, on US 127, in Sherwood, Barrett failed to comply with a traffic stop, and he then created a substantial risk of serious physical harm to persons or property in the area, when he fled from officers on a high rate of speed, until he was ultimately stopped and taken into custody.

Brian L. King, age 43, 431 Walnut St., Defiance, was indicted for Two Counts of Domestic Violence, each a Felony of the Third Degree. Authorities allege that on or about January 1-9, 2025, and on January 9, 2025, at his residence on Walnut St., in Defiance, King caused or attempted to cause physical harm to a pregnant family or household member, and King has two prior convictions for offenses of violence involving a family or household member.

Sarah E. Jackson, age 44, 502 Belmont Ave., Bryan, was indicted for One Count of Failure to Appear as Required by Recognizance, a Felony of the Fourth Degree. Authorities allege that on January 7, 2025, Jackson failed to appear at the Defiance County Common Pleas Court for a change of plea hearing, in connection with the commission of a felony, after having been released on a personal recognizance bond.

Bradford W. Fenter, age 47, 310 E. Wilson St., Bryan, was indicted for One Count of Receiving Stolen Property, a Felony of the Fifth Degree. Authorities allege that on December 22, 2024, on Baltimore Rd., in Defiance, Fenter possessed a stolen license plate that he had reasonable cause to believe had been obtained through a theft offense.

Charles D. Dunten, age 34, 2215 Southway Dr., Ft. Wayne, Indiana, was indicted for One Count of Aggravated Possession of Drugs, a Felony of the Fifth Degree. Authorities allege that on April 2, 2024, during a traffic stop on US 24, in Defiance, Dunten was found in possession of Methamphetamine, a Schedule II drug.

Cody D. Fleming, age 40, 9683 Mark St., Mark Center, was indicted for One Count of Aggravated Possession of Drugs, a Felony of the Fifth Degree, and One Count of Endangering Children, a Misdemeanor of the First Degree. Authorities allege that on November 23, 2024, during a traffic stop on Fountain St. Rd., in Mark Center, Fleming was found in possession of Methamphetamine, a Schedule II drug. Authorities further allege that Fleming also violated a duty of care, resulting in a substantial risk to the health or safety of his child, who was traveling with him at the time of the aforementioned offense.

Scott J. Miller, age 60, 1518 Westgate Dr., Defiance, was indicted for One Count of Aggravated Possession of Drugs, a Felony of the Third Degree, and One Count of Operating a Vehicle While Under the Influence of a Listed Controlled Substance or a Listed Metabolite of a Controlled Substance, a Felony of the Fourth Degree. Authorities allege that on January 2, 2025, on The Bend Rd., in Ney, Miller operated a vehicle while under the influence of Methamphetamine, a Schedule II drug, and he has five prior OVI convictions within the past twenty years. Authorities further allege that during a traffic stop, Miller was also found in possession of over five grams of Methamphetamine, a Schedule II drug.

Timothy D. Moore, age 28, 205 Glenwood Dr., Defiancewas indicted for was indicted for One Count of Failure to Provide Notice of Change in Vehicle Information or Identifiers, a Felony of the Third Degree. Authorities allege that from November 20, 2024, through January 15, 2025, Moore, a registered sex offender, failed to notify the sheriff’s office of his change of internet identifiers, as required, and he has a prior conviction of Sexual Battery. 

Craig M.A. Mosler, age 28, 1954 CR 2.50, Edgerton,

Zachary A. Chervenka, age 32, 2438 County Rd 50, Auburn, Indiana,

Both were indicted for One Count of Burglary, a Felony of the Second Degree, One Count of Grand Theft When the Property is a Firearm or Dangerous Ordnance, a Felony of the Third Degree, and One Count of Theft, a Misdemeanor of the First Degree. Authorities allege that on or about October 27-28, 2024, Mosler and Chervenka trespassed in a residence on Conkle Rd., in Edgerton, with purpose to commit a criminal offense at the residence. Authorities further allege that Mosler and Chervenka then stole firearms and other property from the residence.

Ashley P. Stairhime, age 30, 5105 Havenwood Dr., Unit B, Defiance, was indicted for One Count of Aggravated Possession of Drugs, a Felony of the Fifth Degree. Authorities allege that on December 7, 2024, during a traffic stop on Jewell Rd., in Defiance, Stairhime was found in possession of Methamphetamine, a Schedule II drug.

Codie L. Shirk, age 34, 16413 County Road 149, Defiance, was indicted for One Count of Aggravated Possession of Drugs, a Felony of the Fifth Degree. Authorities allege that on November 26, 2024, during a traffic stop on Ralston Ave., in Defiance, Shirk was found in possession of Methamphetamine, a Schedule II drug.

Ryan E. Gibbs, age 40, 62 Charnel St., Defiance, was indicted for One Count of Aggravated Trafficking in Drugs, and One Count of Aggravated Possession of Drugs, each a Felony of the Third Degree. Authorities allege that on September 27, 2024, Gibbs sold over three grams of Methamphetamine, a Schedule II drug, to a confidential informant, in Defiance. Authorities also allege that on October 9, 2024, at his residence, on Charnel St., in Defiance, Gibbs was found in possession of over three grams of Methamphetamine, a Schedule II drug.

Descardiae E. Jones, age 29, 944 W. State Line Rd., Apt. H, Toledo, was indicted for Two Counts of Burglary, each a Felony of the Third Degree, and One Count of Theft, a Felony of the Fifth Degree. Authorities allege that on or about November 17, 2024 and November 22, 2024, Jones trespassed in a business on N. Clinton St., in Defiance, for which he was previously given a no trespass order, and he did so with purpose to commit a criminal offense. Authorities further allege that on November 17th, 2024, Jones stole property valued at over one thousand dollars, but less than seven thousand five hundred dollars, from the business.

Arraignments are scheduled for Wednesday, February 5, 2025, at 9 a.m.
